Workshop to discuss the draft Law of Ukraine “On ensuring the rights of investors and attract private investment on terms for a mechanism of public-private partnership in the defense-industrial complex” was held on 10 February 2017 at the initiative of the Public Union “League defense industries Ukraine” (League). In particular, the experts made a number of suggestions MP Yaroslav Markevich, who is the author of the bill and in favor of equal opportunity defense industries of the state.
Representatives of the League, which at this time includes more than two dozen military-industrial enterprises, insist on the need to develop the institute of public-private partnership (hereinafter – PPP) in National Security and Defense Council of Ukraine (hereinafter – NNO), and in particular the establishment of equal rights for relevant enterprises both in domestic and foreign markets. They offer prescribe the relevant provisions in this Act referred to Ukraine.
According to the League, today private companies engaged in the production of defense equipment, face a total monopolization of the relevant market areas of the state enterprises. All this, insisting League, in turn, negatively affects the competitiveness of private pidpryyemstvyak the domestic and foreign markets, and create barriers to attracting investment capital and innovative technologies in the field of NNO.
At the same time, explain the League at the regulatory level current legislation of Ukraine expressly allows for PPP arrangements in NNO, thereby making it difficult to ensure proper public interest in this area. So as indicating entrepreneurs, development bill aimed at achieving the priorities of reform the military-industrial complex and the national security system of Ukraine according to the Strategy for Sustainable Development “Ukraine-2020” National Security Strategy of Ukraine.
While common position, Director of NPP “Athlone Avia” Artem V’yunnyk (Member of the Board of the League), outlined the main problems of private entrepreneurs in defense. In his view, the most pressing of these is the CMU №345 «On approval of the supply of weapons, military and special equipment during a special period of emergency and during the counterterrorist operation” in which no side noted that serve defensive techniques; intellectual property rights for the production of defense equipment, etc.
In the League are confident that today’s realities require the adoption of this law, which guarantees equal relations between the state and private enterprises. According to the head of the Center for Army, Conversion and Disarmament (TSDAKR) Valentina Badrak (Member of the Board of the League) to the drafting group appropriate to bring representatives of government circles and create the appropriate group lobbying among MPs.
Defense experts and MPs have agreed to expand cooperation in the field of legislative changes in the area of operation of the defense industry.
